Student charged with assault in bout with police over brother

Also, police responded to some unusual incidents involving alcohol.

A University of Minnesota student was charged with fourth degree assault after attempting to save his younger brother from police officers at TCF Bank Stadium on Saturday.

Michael Sheely, 20, attempted to free his brother Thomas Sheely, an 18-year-old high school student, and was charged with obstruction to a peace officer.

Thomas Sheely was seen shoving a person on the steps at Gate C inside of the stadium. Security officers arrested him for being intoxicated and began to lead him to the processing center when Michael Sheely ran up from behind and jumped on an officerâÄôs back. Michael Sheely swung at the officerâÄôs head with a closed fist, striking the left side of his forehead, according to a police report.

The elder Sheely was “trying to sort of rescue his brother, who was under arrest already,” University police Deputy Chief Chuck Miner said.

The officer ordered Michael Sheely to the floor. When he refused, the officer tackled him to the ground. Other officers were called to assist, and Michael Sheely was handcuffed and brought to Hennepin County Jail, Miner said.

Michael Sheely was booked for assault on a peace officer, and his younger brother was transported to a detox facility.

Both were given breathalyzer tests. Michael Sheely blew .17 and Thomas Sheely blew .18, Miner said.

Blackout in womenâÄôs bathroom

A drunk man was found in the womenâÄôs bathroom during the Gopher football game Saturday.

University of Minnesota-Duluth student Adam David Orcutt, 18, was found in the womenâÄôs bathroom near Gate A. His eyes were watery and red, and there was a strong scent of alcohol on his breath, according to a police report.

“I didnâÄôt know I was found in the womenâÄôs restroom,” Orcutt said. “I just woke up in detox.”

Orcutt was cited for minor consumption.

“ItâÄôs common that we have contact with intoxicated people at the football games, but having a male being in a womanâÄôs restroom is not common,” Miner said.

Too much mouthwash

A man was found passed out in the entryway of Roy Wilkins Hall dormitory, also last Saturday.

Wesley Gene Thomas told police he drank three-quarters of a one-liter bottle of Top Care mouthwash. The responding officer immediately recognized Thomas from previous incidents, according to a police report.

“Generally around Coffman Union or just various places around campus is where we would run into Mr. Thomas and individuals like him,” Miner said.

Homeless individuals like Thomas have sometimes posed a threat to students and faculty but “generally are peaceful,” Miner said.

Thomas was transported to detox and was reissued a trespass warning, the report said.

Thomas has had four previous trespass warnings since about 2008, Miner said.

“They are issued a citation when theyâÄôre violating a trespass warning,” Miner said. “So in this case, he was issued a citation for trespassing and also issued a new trespass warning. So itâÄôs kind of a double whammy.”
