Another “Obamacare” lawsuit thrown out

With another victory for Democrats, they now lead on the health care scoreboard 3-2.

U.S. District Court Judge Gladys Kessler in Washington, D.C. Tuesday threw out a lawsuit that alleged the federal mandate that all Americans purchase health insurance by 2014 is unconstitutional, according to the Associated Press.

Kessler is the third judge to rule on behalf of President Obama’s Patient Protection and Affordable Care Act. U.S. District Court judges in Florida and Virginia have ruled against the mandate.

The D.C. lawsuit was filed by the American Center for Law and Justice, a Christian legal group founded by Evangelist and media superstar Pat Robertson.

Three of the five plaintiffs argued that the mandate conflicts with their religious belief that God will heal all afflictions. Purchasing an insurance plan would cast that belief in doubt, they said.

Kessler specifically noted during her ruling that the U.S. Supreme Court will need to address the constitutionality of the health care overhaul.
